In case the lowest tendered amount (worked out on the basis of the quoted rate of Individual items) of two or more contractors is the same, then such lowest contractors may be asked to submit a sealed revised offer quoting a rate of each item of the schedule of quantity for all sub-sections/subheads as the case may be, but the revised quoted rate of each item of schedule of quantity for all sub-sections/subheads should not be higher than their respective original rate quoted already at the time of submission of tender. The lowest tender shall be decided on the basis of a revised offer.

The Contract means the documents forming the tender and acceptance thereof and the formal agreement executed between the competent authority on behalf of the President of India and the Contractor, together with the documents referred to therein including these conditions, the specifications, designs, drawings, and instructions issued from time to time by the Engineer-in-Charge and all these documents were taken together, shall be deemed to form one contract and shall be complementary to one another.

The Performance Guarantee shall be initially valid up to the stipulated date of completion plus a minimum of 60 days beyond that if the same is submitted by the agency in the scheduled format as per GCC. If the same is submitted on format II as per GCC, then the Performance Guarantee shall be valid up to the stipulated date of completion plus a minimum of 6 months beyond that. In case the time for completion of work gets enlarged, the contractor shall get the validity of the Performance Guarantee extended to cover such enlarged time for completion of work. After the recording of the completion certificate for the work by the competent authority, the performance guarantee shall be returned to the contractor, without any interest. However, in case of contracts involving maintenance of building and services/any other work after construction of the same building and services/other work, then 50% of the Performance Guarantee shall be retained as Security Deposit. The same shall be returned year-wise proportionately.

This form will state the work to be carried out, as well as the date for submitting and opening tenders and the time allowed for carrying out the work, also the amount of earnest money to be deposited with the tender, and the amount of the security deposit and Performance guarantee to be deposited by the successful tendered and the percentage, if any, to be deducted from bills. Copies of the specifications, designs, and drawings, and any other documents required in connection with the work signed for the purpose of identification by the officer inviting tender shall also be open for inspection by the contractor at the office of the officer inviting tender during office hours.

The following modification is made in Rule 23.2 of the "Rules for Enlistment of Contractor in CPWD, 2017.
