वन संरक्षक से ऐसा अधिकारी अभिप्रेत्र जिसे उस वन भूमि जिसके लिए इस अधिनियम के अद्यीन केंन्अीय सरकार का अनुमोदन अपेक्षित है, पर अधिकारिता रखने वाले वन प्रभार का भार धारण करने के लिए प्रभागीय वन अधिकारी या उप वन संरक्षक के पदाभिदान या किसी ऐसे सदृश्य पदाभिदान के अद्यीन यथास्थिति राज्य सरकार या संघ राज्यक्षेत्र प्रशासन द्वारा नियुक्त किया गया है।

The Hon'ble Supreme Court of India in their Judgment dated 6th July 2011 in the Interlocutory Application No. 1868 of 2007 in Writ Petition (Civil) No. 202 of 1995 in the matter of T.N. Godavarman Thirumulpad versus Union of India and others (hereinafter referred to as 'Lafarge Judgment') inter-alia directed that the Ministry of Environment and Forests (MoEF) will prepare a comprehensive policy for inspection, verification and monitoring and the overall procedure relating to the grant of forest clearances and identification of forests in consultation with the States (given that forests fall under entry 17A other Concurrent List).

An Act to recognize and vest the forest rights and occupation in forest land in forest dwelling Scheduled Tribes and other traditional forest dwellers who have been residing in such forests for generations but whose rights could not be recorded; to provide for a framework for recording the forest rights so vested and the nature of evidence required for such recognition and vesting in respect of forest land.

उल्लिखित प्रस्ताव, जिसमें चालीस हैक्टेयर तक वन भूमि वाले प्रस्ताव शामिल है, संबंधित राज्य सरकार अथवा जैसा भी मामला हो, संघ शासित प्रशासन द्वारा अपनी सिफारिशों के साथ पर्यावरण एंव वन मंत्रालय, भारत सरकार से संवृद्ध क्षेत्रीय कार्यालय के मुख्य वन संरक्षक अथवा वन संरक्षण को भेजा जाएगा।

इन नियमों को वन (संरक्षण) संशोधन नियम, 2004 कहा जाएगा। इन नियमों के नियम 1,2,3,5,6 नियम 6 के उप-नियम (5) के अलावा और 7 इनके सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगें जबकि इन नियमों का नियम 4 और प्रद्यान नियमों के नियम 6 का उप-नियम (5) जैसा कि इन नियमों के नियम 5 में निहित है, ऐसे प्रकाशन की तारीख से 180 दिन के समाप्ति के बाद प्रवृत्त होगें।
