This Court has already noticed the judgment passed by the Division Bench, wherein the Division Bench took note of the statement made by the Secretary, The Bihar State Building Construction Corporation Ltd., Patna, Bihar of releasing payment of the contractors. However, the Division Bench has not passed any order on the maintainability of the writ petition, nor it has touched on the said issue.

The respondent is hereby directed to furnish his reply within a period of 8 weeks from the date of receipt of this order. On receipt of respondent's response to the show cause notice dated 20.03.2014 read with letter dated 28.02.2014, the concerned authority is hereby directed to pass a detailed speaking order after due consideration of each of the contentions to be raised by the respondent to the show cause notice dated 20.03.2014 read with letter dated 28.02.2014, within a period of 3 months from the date of receipt of respondent's reply to the show cause notice.

Therefore, one has to draw the inference that litigation CWJC No. 16341/2022 was pending consideration insofar as the petitioner is concerned as of 10.01.2023. In not revealing or disclosing pending litigation of CWJC No. 16341 of 2022 as of the last date of submission of tender application on 10.01.2023 and rejection of technical bid is in order. Therefore, we find no infirmity in the impugned action of the concerned respondent in rejecting the petitioner's technical bid.

In the light of these facts and circumstances, the present petition stands Patna High Court CWJC No.3695 of 2023 dt.20-03-2023 3/3 disposed of reserving liberty to the petitioner to raise all these contentions before the Learned Single Judge in civil review petition arising out of CWJC No. 12193 of 2017, since, he was not arrayed as a party to CWJC No. 12193 of 2017.

Accordingly, the present petition is not maintainable and the writ petition stands disposed of reserving liberty to the petitioner to invoke the appropriate forum. The appropriate forum may take note of Section 14 of the Limitation Act, 1963, or any other relevant provision of law for the purpose of condonation of delay in approaching the appropriate forum.
