The premise on which such notice has been issued, in our estimation, is non-existent, to say the least. We have noted that there is no difference in the content of the two certificates furnished by the petitioner; the second certificate having been called for, for clarification by the Department. Thus, no such proceeding for black-listing ought to have been initiated.

BIADA shall immediately recall the order and/or hand over possession of the unit to the petitioner, whatever the case may be. Learned counsel for the BIADA states that needful shall be done, positively, within a period of four weeks from today.

Respondent No.5, namely, the Project Manager, NHAI, Sasaram, is directed to have the petitioner's case examined and ensure the early decision and disbursement of petitioner's legitimate dues payable, if any, under the scheme, Patna High Court CWJC No.7717 of 2018 dt.23-01-2023 9/10 as also consideration of all claims. This, positively be done within a period of two months from today, failing which costs of Rs.5,000/- shall be paid to the petitioner to be recovered from the personal salary of the officer concerned.
