Provided that on payment of these dues within the said period of one month, all properties seized shall be ordered to be released and shall be handed over to the offender or the owner of the property.

The concerned authority is hereby directed to carry out further proceedings like issuance of specific notice for blacklisting etc. and pass afresh speaking order. Complete the aforementioned exercise within a period of two months from the date of receipt of this order, reserving liberty to the petitioner to file objections and raise all other contentions before the authority in his objections.

If such a deduction is done, necessarily there would be no requirement for the petitioner to pay further 20%, which should be ascertained by the officer before a demand is made.

Learned counsel for the parties also undertakes to communicate the order to the learned Arbitrator. Parties shall file their statement of claims before the learned Arbitrator on such date of hearing which he may fix, as per mutual convenience.

Learned counsel for the review petitioner submitted that the cut date for the purpose of computing four years, 31st December 2009 cannot be taken into consideration. On the other hand, the date of return filed by the petitioner is relevant i.e. 01.06.2009, and it cannot be 31st December 2009 in the light of deeming provision. This Court has already interpreted Rule 21 read with Sub-Section 3 of Section 24 of the Act which is the relevant date for the purpose of computing four years with reference to the due date as on 31st December of the respective year.
