Under the circumstances, the impugned judgment and order passed by the High Court is unsustainable and the same deserves to be quashed and set aside and is accordingly quashed and set aside. There shall not be any deemed lapse of the acquisition with respect to the land in question. The original writ Petition before the High Court Stands dismissed Present appeal is accordingly allowed No. Costs.

In view of the above and for the reasons stated above, all these appeals succeed in part. The impugned common judgment and order passed by the High Court is hereby modified and it is observed and held that the original land owners shall be entitled to the compensation @ Rs. 12,16,800/- for the lands acquired with all other statutory benefits and the interest, which may be available under the provisions of the aforesaid extent. However, in the facts and circumstances of the case, there shall be no order as to costs.

At the relevant time, the employer did not make any application before the commissioner, Employees' compensation to constitute a Medical Board, and the injured be examined by the Medical Board. The employer ought to have made such a request before the commissioner, Employees' compensation at the earliest opportunity. Be that as it may, considering the fact that the appellant did suffer the injuries due to the fall and at the relevant time, it affected his 60% earning capacity, it may not be that nothing was to be awarded to the appellant injured employee be a way of compensation.

The Balance amount of compensation as per the award to be passed under section 34 of the Arbitration Act, shall be deposited by the NHAI with executing court within four weeks after such determination. The said amount shall also be released by the Executing court in favor of the land owners subject to the rights and remedies available to the parties in law with these observation orders passed by the High Court of Bombay date. 01.04.2022 stands modified in the above terms.

The provisions of Section 24(2) providing for a deemed lapse of proceedings are applicable in case authorities have failed due to their inaction to take possession and pay compensation for five years or more before the 2013 act came into force, in a proceeding for land acquisition pending with the authority concerned as on 112014. The Period of subsistence of interim orders passed by the court has to be excluded in the computation of Five Years. In the facts and circumstances of the case, there shall be no order as to costs.
