The committee shall recommend the feasibility of de-scoping & amount of work already carried out by the contractor or continuation as per the scope of the EPC contractor, in case deletion is inevitable. In case of continuation of WSA as per EPC contract, the committee shall submit their recommendation for engaging a specialized agency of building construction and its supervision to have a world-class WSA.

The matter was put up again before EC with views of all FARO vide Agenda item No. 565.07. EC has approved the proposal that there shall be no change in the provision of the Contract Agreement and accordingly, CPI (WI) of the preceding quarter shall be taken for the purpose of calculating price Index Multiple for computation of Completion cost and O&M payments in HAM Project.

The Contractor may reduce the amount claimed, under this scheme, from the award amount while submitting their disputes for settlement on the Portal. The scheme does not apply to cases where parties have already reached a settlement through a conciliation Agreement,

Accordingly, the matter was discussed in EC and it has been decided that in all COS proposals pertaining to utility shifting, the tender discount/Premium will be applicable, as is being applied for civil works, as the utility shifting forms part of the Contract Price.

If such plants/trees require any maintenance in the future, they may be included in the Concession Agreement.
